We’d love to hear Republican Presidential candidate say a variation of these words: “If my competitors don’t believe I’m eligible, they should sue me to resolve it. Otherwise, their silence is acquiescence to my eligibility.”
It’s true. If Donald Trump, Rand Paul, and several other candidates are questioning whether or not Ted Cruz is eligible to be President of the United States, they should sue him. Not doing so is a very clear indicator that they know the truth that his eligibility will be upheld at all levels of the court.
There’s a very dirty and cynical reason that they won’t sue him. They know that he can’t prove his eligibility through court without being sued. It requires and adversary to file suit against Cruz over his eligibility before a judge is even allowed to hear the case. He cannot bring the case to court on his own. None of his allies can bring it to court, nor are they allowed to sue him over it. If President Obama or a member of Congress asked the court to hear the case and rule on his eligibility, the court would be incapable of complying.
In other words, the only people who could bring resolution to this would be one of Cruz’s competitors for the nomination. They, of course, don’t want a resolution. They want this to be a cloud hanging over Cruz. They want it to be an unanswered question. They want to con the American people and prevent them from knowing the truth one way or another.
If there was a good chance that a ruling would go against Cruz, every candidate other than Trump would be rushing to court to make it happen. They only stand to gain by him being declared ineligible. Trump is a different story, though. Eliminating Cruz would spread his supporters to other candidates, and while a good chunk of them would go to Trump, there’s no reason at this point for him to tempt fate. He doesn’t need to. He exists in obscurity and he thrives through misdirection. He has no interest in the truth. He just wants to take down an opponent.
This subterfuge is one of the biggest reasons that Republicans should support Cruz. He couldn’t be attacked on policy or integrity, so his opponents are going with confusing as their choice of weapon against the American people.
